1.-Who is responsible for the processing of your data?
This privacy policy (hereinafter, the “Privacy Policy”) applies to all personal data provided by the user to HOSTAL LAR (JAVIER GIL PÉREZ), with NIF 13118833R and address at C/ Cardenal Benlloch, 1, 2º – 09004 – Burgos, through online forms or when making a purchase on its website (hereinafter, the “Website”).
For the purposes of this Privacy Policy, “User” shall be understood as any natural person interested in the products and services that HOSTAL LAR (JAVIER GIL PÉREZ) offers through its Website.
HOSTAL LAR (JAVIER GIL PÉREZ), as the party responsible for the processing, will request, prior to the provision of personal data, the express consent of the User to this Privacy Policy, when necessary, and to any other aspect that requires the prior authorization of the User.
The User may contact us by e-mail at reserva@hostallar.es with any queries or needs they may have regarding data protection.
2.- For what purpose do we process your personal data?
The User is hereby informed that HOSTAL LAR (JAVIER GIL PÉREZ) will process the personal data provided by the User through the contact and account registration forms on the Website, as well as through the various means of communication established, for the purposes indicated below, to the extent that there is a legal basis for each treatment as explained below:
(a) To guarantee the User access to, and use of, the Website.
(b) To manage the User's relationship with HOSTAL LAR (JAVIER GIL PÉREZ) when contracting, maintaining and monitoring the fulfillment of the contracts for products and services that he/she has with HOSTAL LAR (JAVIER GIL PÉREZ).
(c) Inform the User by any means, including sending commercial communications to the e-mail address provided by the User, of products and services of HOSTAL LAR (JAVIER GIL PÉREZ) similar to those purchased by the User.
(d) To carry out promotional activities about other products, activities and services of both HOSTAL LAR (JAVIER GIL PÉREZ) and third parties, including the sending of commercial communications, electronic or otherwise, to the e-mail address that the User may provide or that HOSTAL LAR (JAVIER GIL PÉREZ) may have obtained through the User's browsing information, in the event that the User gives his or her consent.
3.- What is the legal basis for the processing of your personal data?
The legal basis for the processing of data for purposes (a) and (b) is the execution of the contract to which the interested party is a party.
The legal basis for the processing of data for purposes (c) and (d) is the consent requested from the User, without in any case the withdrawal of such consent conditioning the performance of the contract to which the data subject is a party.

You may request opposition to any of the above treatments based on legitimate interest. To do so, you should write to COMPANY NAME AND ADDRESS AND explain the reason for your objection.
HOSTAL LAR (JAVIER GIL PÉREZ), at the time of providing your personal data, will collect and process the data necessary for registration, access to the User's personal space and contact with the HOSTAL LAR (JAVIER GIL PÉREZ) Customer Service team.
HOSTAL LAR (JAVIER GIL PÉREZ) will collect and process the necessary data (including name, surname, address, e-mail address, etc.) to manage the sending of information requested and for the execution of the contract to which the interested party is to party. Under no circumstances will HOSTAL LAR (JAVIER GIL PÉREZ) transfer, exploit or use this data for any purpose other than that expressly indicated here. During the registration process and the completion of the contact form, the User will be informed of the non-mandatory nature of the collection of some of the data for the provision of the services of HOSTAL LAR (JAVIER GIL PÉREZ).

4.- How long do we keep your personal data?
HOSTAL LAR (JAVIER GIL PÉREZ) will keep the Users' data during the contractual relationship with the user and once the contractual relationship has ended, as well as while the expectation of the rest of the indicated purposes is maintained, keeping them duly blocked during the legal limitation periods in view of the possible liabilities arising from the processing.
5.- Who has access to your personal data?
No data will be transferred to third parties unless legally obliged to do so. The User understands that HOSTAL LAR (JAVIER GIL PÉREZ) may transfer or communicate personal data in order to fulfill its obligations to the Public Administrations in cases where this is required in accordance with the legislation in force at any given time and, where appropriate, also to other bodies such as the State Security Forces and Bodies and the Judiciary.
Notwithstanding the above, HOSTAL LAR (JAVIER GIL PÉREZ) has the collaboration of some third party service providers who have access to your personal data and who process the aforementioned data in the name and on behalf of HOSTAL LAR (JAVIER GIL PÉREZ) as a result of the provision of services. HOSTAL LAR (JAVIER GIL PÉREZ) follows strict criteria for the selection of service providers in order to comply with its data protection obligations and undertakes to sign the corresponding processing contract with them.
6.- What are the rights of users?
HOSTAL LAR (JAVIER GIL PÉREZ) informs the User about the possibility of exercising free of charge the rights of access, rectification, opposition, suppression, portability and limitation of the treatment, as well as to refuse the automated treatment of personal data by means of a written and signed request addressed to the following address: C/ Cardenal Benlloch, 1, 2º – 09004 – Burgos.
To this end, the User must send said written communication indicating the request or right being exercised, name and surname, address for notification purposes, together with a copy of their ID card or valid document accrediting their identity (photocopy of passport). In the case of representation, this must be proven by means of a valid document. Likewise, the User may also exercise their rights by sending a photocopy of their ID card (or passport) on both sides via the “Contact us” form, if it exists, or by sending it to the e-mail address we have indicated.
The User has the right to oppose the processing of their data for promotional purposes for the receipt of commercial communications by simply notifying HOSTAL LAR (JAVIER GIL PÉREZ) of their wish to do so. To do so, the User may send his/her request by means of the procedure described in the previous paragraph. Likewise, the User may cancel the receipt of commercial communications by sending an e-mail to reserva@hostallar.es or by post to C/ Cardenal Benlloch, 1, 2º – 09004 – Burgos.
In addition to the above rights, the User shall have the right to withdraw the consent given at any time by means of the procedure described above, without this withdrawal of consent affecting the lawfulness of the processing prior to the withdrawal of consent. HOSTAL LAR (JAVIER GIL PÉREZ) may continue to process the User's data to the extent permitted by applicable law.
HOSTAL LAR (JAVIER GIL PÉREZ) reminds the User that he/she has the right to file a complaint with the Spanish Data Protection Agency.
7.- From what age can the User access our products and services?
We cannot and do not wish to collect personal data from any person under the age legally established by each Member State. If HOSTAL LAR (JAVIER GIL PÉREZ) becomes aware that a minor has provided personal data, having falsified the previous requirements (date of birth when accessing) we will proceed to cancel these personal data from our files.
8.- Quality of data
HOSTAL LAR (JAVIER GIL PÉREZ) warns the User that, except in cases of legally constituted and accredited representation, no User may use the identity of another person and communicate their personal data, so that the User must at all times bear in mind that they may only provide personal data corresponding to their own identity and that they must be adequate, relevant, current, accurate and true. To this end, the User shall be solely liable for any damage, direct and/or indirect, caused to third parties or to HOSTAL LAR (JAVIER GIL PÉREZ) by the use of personal data of another person, or their own personal data when they are false, erroneous, not current, inadequate or irrelevant. Likewise, the User who communicates the personal data of a third party shall be responsible to the latter for the obligation to provide information when the personal data has not been obtained from the interested party himself, and/or for the consequences of not having informed him and, where appropriate, obtained his consent.
In the event that the User provides any personal data of third parties, he/she undertakes to previously inform these persons of the intention to communicate their data to HOSTAL LAR (JAVIER GIL PÉREZ) and to obtain their prior, express and written consent for said data processing and any purposes for which they are to be processed, with the User being responsible otherwise.
The User is the only source of information about their personal data, so HOSTAL LAR (JAVIER GIL PÉREZ) requests that, in order to keep their data updated and up to date at all times in accordance with the principles of Regulation (EU) 2016/ 679 of the European Parliament and of the Council of 27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repeating Directive 95/46/EC (GDPR), please communicate any variation of the same to the address reserva@hostallar.es, by selecting the corresponding option in the Contents, if any, or by sending an email to the address we have indicated. Users are reminded that in order to update their data, they must prove their identity by providing a photocopy of their National Identity Card or equivalent document.
9. Modification of the Privacy Policy
HOSTAL LAR (JAVIER GIL PÉREZ) may modify its Privacy Policy in accordance with the legislation applicable at any given time. In the event that the applicable regulations are required, we will give you the opportunity to give your consent again.
